Introduction to Our Courts System:

The hierarchy of Pakistan judicial system is as under:-

District Courts, High Courts and Supreme Court, besides there are Special Courts, Provincial as well as Federal and also Tribunals (Provincial and Federal).

The District Courts are further categorized as Civil Courts and Criminal Courts. The Civil Courts are of 3 classes, i.e. Civil Judges-Class-III, Civil Judges-Class-II and Senior Civil Judges-Class-I. Appeals against their judgments, decrees and orders are filed before the District Judge who either hears the same himself or transfers to the Additional District Judges. Appeals and Revision against the Orders of the District Judge and Additional District Judge are filed before the High Court. In selected matters Appeals, through special leave can be filed before the Supreme Court, the apex court.

Similarly Criminal Courts are categorized as Courts of Judicial Magistrates, Assistant Sessions Judges, Additional Sessions Judges and Sessions Judges. The Appeals against the Judgments of the Judicial Magistrates/Assistant Sessions Judges are filed before the Sessions Judge, who either himself hears the same or transfers to an Additional Sessions Judge.

The District and Sessions Judge has original jurisdiction of Civil Cases as well as Criminal Cases also the civil jurisdiction is in respect of summary suits i.e. for recovery of an amount based on negotiable instruments (cheques, pay orders and promissory notes) as well as the matters relating to the Succession and the Letters of Administration. The Criminal jurisdiction is in respect of those cases which are triable by the Court of Sessions under the Criminal Procedure Code or Special Law.
